Esteemed Madam
Until now I was aware of DNB awarded to postgraduates. Only one subject - Family Medicine - was available to MBBS doctors. Sale of additional qualification to postgraduates is understandable in the sea of corruption we live in. I was just STUNNED to find some one MBBS, DNB (Anaesthesia).
In order to discuss the new development, let us recapitulate etiology and pathogenesis of the problem.
Indian Medical Council (IMC) maintains Indian Medical Register of all medical graduates, MBBS and obsolete LSMF, in the country. State Medical Councils enrol doctors for Indian Medical Register and maintain record of those enrolled through them. As per Indian Medical Council act :-
1. State Medical Councils enrol doctors for Indian Medical Register.
2. A doctor enrolled in Indian Medical Register through any state medical council need not and cannot be enrolled through another state medical council even in case of physical abode or migration.
Through innovative ideas of Father of Spurious Medicare in India - Hon'ble B Shankranand, IMC became a goldmine collecting unaccounted wealth from recognition of medical colleges, first in Karnataka and then all states. The same health minister stuffed IMC, ICMR, AIIMS and other institutions with all his coterie. Still many more could not be accomodated and he established National Board of Examinations only to accomodate some redundants. For years all duties of NBE were delegated to National Academy of Medical Sciences - NBE staff was only drawing salaries.
I cannot commernt on situation in metros but in Bihar MAMS renamed as MNAMS renamed as DipNBE renamed as DNBE renamed as DNB was always available for Rs1-5 lakhs. The pancorrupt people associated with IMC by then had enviably huge quantum and source of wealth. Obviously that could not be acceptable to states for long.
Government of NCT of Delhi CRUSHED IMC constitution, passed DMC Act with morbid, malafide and draconian laws. Needless to mention that all corrupt, worthless and bad people in medical profession grabbed the charge of Delhi Medical Council. These people collect crores of rupees from TINY hospitals (even 200 sq meters) for recognition as postgraduate teaching institutions. The students enrolled are exploited in every possible manner, by hospital authorities and DMC rogues. The students undergo everything, except teaching, and get away as postgraduate doctors.
At the top of it, DMC hosted a conference of all state medical councils and incited them to revolt against provisions of IMC.
Last night on Total TV Health Minister Ms Kiran Walia indicated that just about 40 thousand doctors are enrolled with DMC - just over 10% of all doctors in Delhi, despite the malafide DMC Act 1997 punishment provisions against doctors not enrolled with DMC.
On same channel, you made a COMMENDABLE statement on Gutkha - We do not wish to make laws that cannot be implemented.
Then why doctors in Delhi are forced to digest a malafide law and :-
1. agree to governed by people bad, with all parameters;
2. pay mountainous fees - I paid one time charges of Rs60 to Punjab Medical Council during 1970. DMC does not require any capital  except for the purpose of intended grabbing by office bearers;
3. remain under suspension threats for not obliging DMC rogues?
If the DMC went into notorious gangs, during previous regime, you can at least maintain status quo and request your minister not to hurt sentiments of 90% doctors by broadcasting DMC registration as mandatory.
Mandatory registration with DMC is a law that cannot be implemented without inviting affected doctors' fury. And no doctor wants to bell the cat. Else this law would be quashed, with strictures, during first hearing in any court of law.
Just have a look at DMC advertisents in DMA News Bulletin. For months no one in DMC had wits to notice and correct the BLUNDER - requirement of PG qualification for renewal of DMC registration.

Dr Girish Tyagi was sacked from the post of Hony Secretary, Delhi Medical Association, by a court ON CORRUPTION CHARGES. Immediately he was appointed as registrar of DMC. The administrative post involves no medical skills and could go to any nonmedico administrator.


I am registered on Indian Medical Register through Punjab Medical Council and not required to pay any more charges for rest of my life. Why should I be made to pay capitation fee and recurring charges to DMC? Also, all funds collected are only for grabbing by corrupt people. 
Medical Profession Pithed - ASJ RK Sharma has found Dr Chander Prakash of Sunder Lal Jain Charitable Hospital, guilty under section 304 IPC (culpable homicide not amounting to murder) for refusal to treat accident victim without advance payment. The judgement may force some hospitals to shut down. Others may shoot up their routine tariff to make up for nonpaying emergency patients.

Ramadoss Aids His Family's Welfare

HEALTH AND Family Welfare Minister Anbumani Ramadoss takes the responsibility of family welfare very seriously. Over the past year, the Health Ministry's nominee, to several important medical boards, has been urologist A. Rajasekaran, whose most important qualificafion seems to be the fact that he is Ramadoss' sister's father-in-law. 
Rajasekaran has been made chairman of the National Board of Examinations that grants (read SELLS) the DNB post-graduate degree to doctors, chairman of the staff selection commiittee in charge of staff appointments at AIIMS, and member of the post-graduate committee of the Medical Council of India (MCI).. 
"Rajasekaran is now controlling the post-graduate medical education of the entire country as he is associated with all the boards that give (read give OR SELL) PG degrees : MCI, NBE and AIIMS", says a ministry official. 
Dr Rajasekaran first appeared on Delhi's medical radar when the PMK joined hands with the BJP in 1998 and PMK's Dalit Ezhumalai became Minister of Health. He promptly appointed Dr Rajasekaran as the government's nominee to the AIlMS' institute body and chairman of the staff selection committee. 
When Dr C.P. Thakur took over as Health Minister in 2000 Dr Rajasekaran was removed from the selection committee on charges of "misappropriation in appointments at key positions in AIIMS". He, however, retained his institute member position, because it has a five-year tenure. 
At the end of five years, the PMK had become part of the  UPA government and Rajasekaran was once again nominated as member of the newly constituted institute body of AIIMS. 
 This year, the health ministry has also made him a member of the post-graduate committee of the MCI. Incidentally, Rajasekaran had contested the election for President of MCI in 2001 and got only 4 of the 73 votes. 
Health minister Anbumani Ramadoss says Rajasekaran is fully qualified for the many posts he holds. "He's a very eminent doctor in the field of urology and andrology and has been the head of Urology at Madras Medical College. Several doctors such as R. A. Mashelkar and Ranjit Roy Chaudhury are also members of several boards, but no one objects to that because they are well known in Delhi. We chose Rajasekaran because we wanted southern India also represented in national bodies", says Ramadoss 
Every statement from dens of corruption may have two meanings. However, it cannot be disputed that the annexed document rules out renewal of registration without Post-graduate Degree/Diploma/Post-Doctoral Degree Certificate. 

What better can we expect from people butchering the constitution for personal gains?

Subject : Delhi Medical Council - Doing Everything Unconstitutional  

Esteemed Sir  

Apropos article (HT March 25) and advertisements in Punjab Kesari March 26, 2003 suggesting Delhites to make sure that treating doctors are registered with Delhi Medical Council. 
The article itself admits that Delhi Medical Council cannot take any action against doctors registered elsewhere. Yes, medical practitioners in Delhi are not bound to be registered with Delhi Medical Council. 
According to Indian Drugs & Cosmetics Act 1940, a registered medical practitioner is one who is either registered with Indian Medical Council or is eligible for registration with IMC and has not been debarred from holding such registration. Hence registration with IMC is desirable but not mandatory (in courts). 
According to Section 21(1) of the IMC Act 1956

The Council shall cause to be maintained in the prescribed manner a register of medical practitioners to be known as the Indian Medical Register, which shall contain the names of all persons who are for the time being enrolled on any State Medical Register and who possess any of the recognized medical qualifications. 
----------- 
The state medical councils enrol medical practitioners for listing in Indian Medical Register. Dual membership is refused if a practitioner registered with a state medical council applies for direct IMC registration or registration with another state medical council 
According to section 27 of IMC Act 1956

Subject to the conditions and restrictions laid down in this Act regarding medical practice by persons possessing certain recognized medical qualifications, every person whose name is for the time being borne on the Indian Medical Register shall be entitled according to his qualifications to practice as a medical practitioner in any part of India and to recover in due course of law in respect of such practice any expenses, charges in respect of medicament or other appliances, or any fees to which he may be entitled

The Delhi Medical Council has been established under the Delhi Medical Council Act, 1997. The act cannot be located on internet or in the market. If Delhi Medical Council registers medical practitioners for Indian Medical Register, registration of doctors already registered elsewhere would be void, under IMC Act. If  DMC registration of doctors is not for Indian Medical Register, the legislation itself is void as superceding the provisions of IMC Act. All doctors registered with DMC have to be registered elsewhere too for eligibility to practice even in Delhi. 

Delhi Medical Council comprises some ambitious doctors with political patronage. Perhaps they have never glanced Indian Medical Council Act  and have no aptitude for law and legislation. An occasional article appears every few months and is eventually forgotten. I request the media to verify the statements to avoid misreporting in future.

Subject : Clarification on registration of doctors in Delhi. 

Esteemed Sirs 
Some years ago, I had availed maximum number of duplicate registration certificates issued by Punjab Medical Council. Just to avoid any future emergency, I applied for registration direct with MCI and with UP Medical Council. Both the requests were declined on following ground 
----------------------- 
State medical councils register medical practitioners for enrolment in Indian Medical Register and maintain their own register for administrative needs. A practitioner enrolled in Indian Medical Register cannot be registered again by another state medical council even in cases of physical interstate shift. 
----------------------- 
In view of the contrary practice and propaganda by Delhi Medical Council, you are requested to let me know which of the following options holds true. 

Option 1. Delhi Medical Council registers medical practitioners for Indian Medical Register and dual registration of practitioners already registered elsewhere is now permitted. 

Option 2. Delhi Medical Council registration is not covered by section 21(1) IMC Act 1956. The doctor has to seek additional registration from another state medical council also to be eligible for practice in Delhi. 

Option 3. Delhi Medical Council registration is not covered by section 21(1) IMC Act 1956. Registration with Delhi Medical Council supercedes article 27 of the IMC Act and enrolment in Indian Medical Register is not mandatory for practice in Delhi.

A Directive A Day Keeps The Doctor Away "From Profession"
 
Virtually, every morning when I browse through two newspapers, I come across a directive for doctors, from Delhi Govt, Health Directorate or Delhi Medical Council. Perhaps they have 365 directives and advertise every one of those just once a year. 

Belonging to a big (or the biggest) political party, they may have innumerable achievements to boast of. Every party worker contributes to such achievements and may be ispired by photographs of national and local leaders associated with advertisements displaying such achievements. Where is roll of portraying chief minister and health minister at the top of directives? 

Quarter century ago an MBBS doctors had just two requirements (own confidence and patient's faith) to treat any disease and operate upon any organ. Without any qualified assistants (but competent through experience) and without premises with prescribed specifications, they admitted patients from slums, JJ colonies and middle class population against affordable charges. Every quarter, they either paid bribes to DDA staff or appeared at Patiala House courts for misuse of residential premises. By any criteria, they could not be perceived as threat to healthcare. With mushrooming of such petty nursing homes, Dr NK Grover and his associates U-turned the roll of Delhi Medical Association, connived with DDA officials and others to make rules stringent. With the time, they made sure that a dehydrated patient can be administered intravenous glucose only by a postgraduate doctor who has invested a few crores initially and spends a lakh every month on qualified assistants and equipment maintenance. A decade ago I was stunned when a person entered my nursing home in a car and introduced : 
I am                , Deputy Director, DDA. We were surveying medical establishments and Delhi Medical Association requested us to cooperate and collect information for them also. He gave me a Delhi Medical Association form to fill up. 
I just refused, protested against this over telephone to president and secretary, and faxed his car number to CBI, Chief Minister and Prime Minister. What a role! Delhi Medical Association sending DDA Deputy Director as its representative! 
With unhealthy competition wiped away, a woman aspiring for child birth must make a provision of Rs one lakh for complicated caesarean section - the incedent of which has shot up firstly because the elite breed of doctors has no time to wait for normal delivery and secondly because costly antibiotic vials keep shuffling between chemist shop and patients' rooms without actually being injected. 
The obvious casualty has been MBBS qualification. Every day directives have limited the role of MBBS doctors to referral commission agents. With battery of association leaders very keen to testify "inadequate qualification" in any case of complication, an MBBS doctor now knows the legal implications of the profession involving human lives. More and more doctors are forgetting they ever passed MBBS and are shifting to safer professions.

Jawaharlal Nehru used to reply every letter with his signatures. Indira Gandhi and Rajiv Gandhi followed the suite. Perhaps, not having faith in coming congress generations, he opted not to leave behind that culture. Now a sure reply can be expected only from Kidar Nath Sahni.

New abortion facility
New Delhi: With the amendment of Medical Termination of Pregnancies (MTP) Act, 1971, abortions can be conducted at all government hospitals or any other medical institution approved under the MTP Act, informed Delhi minister of health and social welfare, Yoganand Shastri. 
He said the move was aimed at preventing people from visiting makeshift facilities for getting abortions done which can prove fatal. TNN
 
Right since 1971, abortions have been legally conducted at all government hospitals or any other medical institution approved under the MTP Act. I attempted to analyse the above news the Yoga way, the Ananda way, and the Shaastra way but failed to find any news in it.
The people entrusted with healthcare in Delhi know nothing about law and legislation, nothing about administration, nothing about medicare. They have been planted by medical mafia to pith the medical profession, hunt the doctors out of profession and ease the competition. A politician or an officer connected with health department, misnaming Medical Termination of Pregnancy (MTP) Act, 1971 should adequately support my contention.
Medical Termination of Pregnancy (MTP) Act, 1971 is a central act. How is a Delhi govt minister concerned with its amedment?
Absence of location and audience of information, along with no content status, would construe the news as a sample of bad reporting.
Through a malafide piece of legislation, they assumed powers to flout provisions of a central act (Indian Medical Council Act). At the top of it they arranged a workshop of all state medical councils to designate such bad legislation as Model Legislation.
Legislations are not intended to prevent fatalities. Those are manipulated to restrict glucose infusion to a hundred crore premises only. A parent must sell his rickshaw or jhuggi to get the child admitted in a hospital.
The neighbouring MBBS doctor is not allowed to attend.
