Esteemed Sirs
At the outset, I question establishment and utility
of your committee by perpetrators of rape culture. Justice JC Verma Committe
has been established as consequence of fuming demonstration by those who
are never heard against those who never hear. You may find a decade long

the president, the prime minister, the communication minister, CVC, CBI,
Police Commissioner, others - these people don't understand english or
any other cultured/civilized language, not even the language of demonstration
and shoe-herald - only VIOLENT demonstrations wake them up sometimes.
Every town in India harbours a sex racket run
by a magistrate, a revenue officer (ITO/STO), a police officer, a politician,
some teachers. Members of racket receive government recruitments and speedy
promotions, particularly as principals/wardens. This menace is not recent
but dates back to independence. It has only been rendered unmanageable
during recent times. Half a century ago, I knew a pimp making everyday
appearance at offices of all politicians in the town. Quarter century ago,
I appeared for sales tax hearing in Delhi. After negotiating my case, ASTO
bade me goodbye with a smile - Kabhi aapko female assistant ki zaroorat
ho to mujhe bataa dena; main aap ke matlab ki ladkee bhej doonga. Just
a day before that, I overheard a telephone conversation of a scientific
dealers running placemnent service too -
...koyee baat naheen. Agar usmein koyee kamee hai to mein doosri secretary
bhej doonga. Chhoti moti complaints to aati rehti hain. Hum turant action
lete hain
Members of sex rackets are made special magistrates
and special police officers.
Sex rackets are run by telecom companies under
the garb of dating/matching and through SMS.
Police stations refuse to book FIR. I have only
read about such refusal in rape cases. At Paschim Vihar police station,
I was refused FIR against :-
1. fake lottery SMS, involving nigerian criminals,

2. use of Army HQ telephone numbers as contact
numbers of an EMI card fraud company - http://ukmall.net/undigested/ismart
3. theft at my shop. Agar aap ka samaan baraamad
ho jaata hai hum haath jod kar aap ke hawaale kar denge. Agar FIR darj
hotee hai to vohi samaan case property ban jaayega.
Most rape incidents are aberrant projection of
sex rackets run by rulers and prospective rulers. I doubt if Justice JC
Verma Committe or any such body can have any role in prevention, remedy,
or punitive aspects of rape.
You perhaps have rape figures around 300 per
year or one rape per WORKING day. If consent under pressure, favour, incentive
is not construed as genuine consent, a hundred rapes go on at every point
of time in Delhi.
The committee as also its findings/suggestions
are destined to be trashed after demonstrations subside. Still I wish you
best of luck in this NOBLE venture.

Some time later I faced a Sales Tax Officer for sales tax assessment of my diagnostics business. Going slightly off the track, he proposed,"Kabhi aapko competent female secretary ya assistant kee zaroorat ho to bata dena. Mein aapko aapke matlab ki ladki bhej doonga". Many polititians, doctors and others keep importing unemployed youth from their towns and help them in placement. I thought the STO was also doing the same, or else trying to help out a needy girl around.
After many years, media exposed involvement of politicians,
judges, police officers, and other high ups in sex rackets. After clubbing
up all information available, I infer that, in most indian towns, sex racket
team comprises a judge, a police officer, a revenue officer, some teachers
and politicians. Lady members of the team jump up the promotion ladder
in government jobs and appointed as Special Police Officers.

A prominent political leader
made some remarks at demise of a religious leader. Later the same remarks
were retracted with the remark that remarks made at kirya cermony are applicable
only to that ceremony and don't reflect mood and attitude of the speaker
outside. That is what applies to hue and cry launched after every reported
rape.

Perhaps wrongly presuming rape as equally compoundable charge, let me apply my court experience to a hypothetical sequence in a rape case proceedings.
1. The culprit, paying a monthly sum to the police, thrives on pick-pocketing and looting in his area. He simply remains listed on police list of bad elements and is questioned every time a major event occurs in the area.
2. He spends soft-earned money on wine and women. Police, NGO's, Media are not concerned as both man and woman are willing.
3. He teases women who just ignore the matter.
4. He is caught eveteasing and molesting. He is thrashed on road side. Cops just stare from a distance and remain unconcerned in absence of complaint. Someone injured in the melle goes to private nursing home for first aid. Every one forgets incidence.
5. A victim is dragged/driven to secluded place and raped. She reaches home. The family is raged instantaneously but, after careful consideration, opts only to console the victim. She is taunted by immediate relatives and friends as a rape victim, not absolutely free from her own fault.
6. Another victim manages to reach police station. Right at the gate and in corridor, she is advised to avoid public disgrace and forget the incidence. She brings her parents - they are also persuaded and the matter ends.
7. Many persons may be lucky and may not be caught during life time. With a stroke of bad luck, the culprit is eventually caught. A case is filed in the court. The guy enjoys holidays with his friends (police) providing with all amenities. After six months, girl is summoned to the court as witness.
First Date (23rd July)
The girl was raped on tuesday,
18th January around Buddha Jayanti Park. She is tutored to state the day
as thursday and date as 20th January since FIR was written only after avoidance
for two days. She is also tutored to change venue from Buddha Jayanti Park
to Shaker Road because of technical reasons. The victim agrees to state
that she was raped on Shanker Road on thursday and identify culprit's watch
and bunch of his hair recovered from that spot in her presence. Eventually,
the judge has to leave early and case is adjourned to 8th January.
Second Date
Defence counsel approaches
the victim family and cites cases pending in courts for decades. Offers
to pay 300-400 rupees as settlement amount.
Public Prosecutor asks if
the settlement has been reached. Then he deposes before the court,"Sorry,
case property could not reach here since locker incharge is on 3-day leave".
Case adjourned to 5th August.
3-6th Dates
Case adjourned because investigating
officer had unfortunate death in family, lawyers on strike, judge too busy
elsewhere..........
7th Date
Defence counsel approaches
the victim family and cites cases pending in courts for decades. Offers
to pay 1000-1200 rupees as settlement amount.
Public Prosecutor asks if
the settlement has been reached. On protests, he claims,"There is nothing
wrong in proposing a compromise. Even the hon'ble judge can persuade a
compromise". The judge just gives affirmative look. Case adjourned.
8-10th Date
Victim fails to appear on
two occasions. Served bailable warrant. Father furnishes a bond of Rs10,000/-.
Warrant cancelled
11th Date
The girl screams she wants
to get rid of court. She is overheard as agreeing that she would not identify
culprits or even the incident. That day nothing goes amiss. Her statement
is recorded as hostile. She is fined Rs500/- for skipping some dates and
her father Rs500/- forfeited as a part of bail bond.
After a few months, the learned police officer visits girl's father asking if he has address of the acquitted person, "Usne ek aur kes kiya hai. Maine socha woh kabhi aap se milta raha ho aur aapke paas apna ata pata chhoda ho. Mein usee ko dhoond raha hoon aur sab se pahle aap ke paas haazir hua hoon".
1. Dr Mrs Nigam is an esteemed member of medical profession. She and her daughters should be extended full cooperation and consolation in such traumatic phase of her life.
2. I don't suspect it in present case but it is going to be used as a rivalery tool. Use a call girl from the front, from the back and through the lips, push her into doctor's chamber and begin shouting. All NGOs and medical examination would endorse your contention and the doctor would be castrated from medical profession for rest of his life, after jail sentence.
1. Any planet in 12th house makes the subject inclined to sex. Saturn
